Important deadlines in the workers’ compensation claims process

You may be entitled to benefits when you suffer a workplace or work-related accident. However, you must go through the paperwork and legal procedures. In Arkansas, the workers’ compensation claims process has specific deadlines that you must adhere to as a workplace accident victim. 

Understanding and meeting these crucial timelines is essential to ensure a smooth and efficient claims process. It also protects your claim from being time-barred, which limits your legal options. Below are some crucial time limits you should keep an eye on.

Reporting the injury

You must provide reasonable notice of your workplace accident to your employer. While Arkansas law does not explicitly define the duration you have, it is advisable to do so immediately after the accident. You may waive your right to claim compensation benefits if you do not notify your employer of the accident.

Seeking medical attention

There is no deadline within which you should seek medical attention for your claim, but the sooner you do so, the better. Medical evidence can help your claim by establishing the cause and extent of your injuries. Remember to visit an employer-approved doctor or physician unless it is an emergency.

Filing the formal claim

You have two years to file a claim formally. The window is much shorter in some cases where you only have one year. Beyond that, it may be impossible to get any benefits as your claim is essentially closed. The clock starts ticking from the moment you suffer a workplace accident.
