While it can be frustrating when your workers’ compensation claim is denied, you are not alone. Many people face denials for various reasons. There are steps you can take to appeal the decision.

First, it’s important to know why your claim was denied. Common reasons for denial include missing deadlines, lack of evidence or disputes over whether your injury is work-related. Your denial letter, sent after an unsuccessful claim, should explain the reasons behind the decision.

Next, it helps to gather evidence that supports your claim. This primarily depends on the reasons your claim was denied. For instance, you may need additional medical evidence to prove that your injuries are work-related. It’s also important to keep track of all communication and relevant records related to your claim.

Understand how the appeals process works

The entire appeals process can be lengthy, and there are deadlines involved for filing appeals. As such, it’s crucial to act promptly to avoid running into legal complications.

In a nutshell, the process begins by requesting a hearing, where you state the reasons for your appeal and present evidence in your support. If efforts to resolve the matter outside the courtroom are not successful, you will attend a hearing where a judge will determine the matter.

It is worth noting that the judge’s decision is not final. You can further appeal their decision to the full Workers’ Compensation Commission, then to the Arkansas Court of Appeals and, finally, the Arkansas Supreme Court if necessary.
