Helping Injured Workers Contest Denied Workers’ Comp Claims

Having your Arkansas workers’ compensation claim denied can be disheartening. Unfortunately, such denials are not uncommon. It is crucial to understand your options for pursuing the relief you need in the face of this setback. As an experienced Little Rock workers’ compensation lawyer, I know what it takes to successfully challenge workers’ compensation denials here in Pulaski County. Here at Daniel A. Webb, PA, I stand ready to guide you and cover all the angles in the fight for the benefits you deserve.

Common Reasons For Workers’ Comp Denials

Employers and their insurers may give a range of reasons for denying workers’ compensation claims. Examples include:

  • Missed deadlines
  • Paperwork mistakes
  • The injury is not work-related
  • The worker is an independent contractor
  • The injury was due to horseplay or other intentional conduct

Understanding the specifics behind why your claim was denied is key to determining the best steps forward. A skilled workers’ comp lawyer can provide key guidance on this front.

Exploring Settlement Options

Sometimes, denials can be resolved through negotiations with the employer’s insurer. Having a strong and creative advocate can be critical when seeking a workable solution using this route. I can help you explore and pursue settlement opportunities in a way that safeguards your rights.

Appealing To The Arkansas Workers’ Compensation Commission

Another avenue for trying to reverse a workers’ comp claim denial is a formal appeal. The typical steps include:

  • Filing your initial request: You do this by completing Form C and filing it with the Arkansas Workers’ Compensation Commission. The deadline for doing this is typically two years after the injury.
  • Mediation: Often, the case will then go into this form of alternative dispute resolution. A neutral mediator will facilitate talks to try to help you and the insurer reach a settlement.
  • Administrative law judge (ALJ) hearing: If mediation doesn’t lead to a settlement, you can request a hearing for an ALJ to decide on the case.
  • Full commission appeal: If you disagree with the ALJ’s decision, you can request a review by the full commission. You must make this request within 30 days of the ALJ’s decision.
  • The Court of Appeals: If you disagree with the full commission’s decision, you can challenge it by filing a case with the state’s Court of Appeals.

With my extensive knowledge of Arkansas workers’ compensation law, I can guide you through the intricacies of the appeal process.
